Leaders have continued to express divergent views on the solution to the crisis in the ruling All Progressive Party APC.

Its former National Legal Adviser , Babatunde Ogala, SAN, on Friday said the current Governor Mai Mala Buni-led Convention and Caretaker Committee should be dissolved immediately.

He said this has to be done to allow the National Executive Committee (NEC) of the party to resume its duties to save the party from an impending doom.

Ogala countered the position of the party’s National Legal Adviser, Chief Niyi Akintola, who said on Thursday that the judgment of the Supreme Court in the case of Rotimi Akeredolu and Eyitayo Jegede did not portend any danger for the party.

In a position paper made available to the NPO Reports on Friday, Ogala said the position and suggestions he is offering are devoid of any selfish agenda but one with capacity to save the party from imminent danger.

 

Ogala said the stand of the Supreme court justices has created for the party what he called “legal quagmire.”

 

He said, “This creates a legal quagmire for APC in respect of all elections and actions carried out by the Governor of Yobe State in his acting capacity as Chairman as there seem not to be a clear position of the Apex Court on same. A close reading of Section 183 of the 1999 Constitution provides a basis for the attitude of the Supreme Court. It states that:

 

“The governor shall not, during the period when he holds office, hold any other executive office or paid employment in any capacity whatsoever”.

 

Saying that the law is not on the side of continued stay in office of Buni, Ogala said the minority decision of the court cannot be ignored.

He said, “The minority decision backed by the majority’s action of not ruling otherwise on this point sends a strong message which we cannot ignore.

“Without equivocation, the law is not on the side of perpetuating serving Governors including Governor Mai Mala Buni in the leadership of the Caretaker Extra-Ordinary Convention Planning Committee.”
